These Terms of Service ("Terms") govern the access and use of the TackrJobs platform, owned by Tackr LLC. By using our platform, you agree to these Terms. If you do not agree, you must not use the Services.

1. General Information

Company Name: Tackr LLC
-
Legal Jurisdiction: State of Delaware, United States
-
Covered Services: use of the TackrJobs platform (ATS, Career Page, AI tools, job postings and boosting, credit system, talent database, and other associated features).
2. Eligibility and Access
-
Use is limited to individuals over 18 years old and legally registered companies.
-
A user may manage multiple company accounts.
-
You are responsible for maintaining the confidentiality of your credentials and all activities under your account.

Prohibited activities: illegal or fraudulent purposes; uploading false or infringing information; scraping, data mining, or unauthorized access; harassing or harming other users.
3. Registration and Required Data
To register, you must provide the information specified in the Privacy Policy (personal, company, and technical data, as applicable). You guarantee that all provided information is accurate and kept up to date.
Companies that use the platform represent and warrant that:

They have the legal right to upload candidates’ personal data

They have informed candidates about the processing of their data

They have obtained any required consents where the law requires

They comply with GDPR, CCPA, and all other applicable laws
4. Subscriptions

Monthly and annual plans. Annual plan offers a 50% discount compared to monthly pricing.

Pricing (USD): Standard plan $78/month or $39/month (billed annually). Advanced plan $198/month or $99/month (billed annually).

Automatic billing on the 1st of each month, covering the full calendar month. If a subscription starts after the 1st, only a prorated amount is charged, but the full credits for that month are granted.

Failed payment: 7-day grace period with retries every 2–3 days. After 7 days, the account is downgraded to the free plan.

Free plan: 10 Match Score per month.

Standard plan: 3,000 Match Score per month.

Advanced plan: 10,000 Match Score per month.
Plan Changes – Billing Policy

🔼 Monthly → Monthly (upgrade): Total to pay = ((PlanB − PlanA) / DaysT) × DaysR.

🔽 Monthly → Monthly (downgrade): Effective next billing cycle; current month remains unchanged.

🟢 Monthly → Annual (upgrade to higher plan): Total = [((PlanB − PlanA) / DaysT) × DaysR + (11 × PlanB)] × 0.8.

🔽 Monthly → Annual (downgrade to lower plan): Plan changes to annual lower tier; billing applied from next month.

🔼 Annual → Annual (upgrade to higher plan): Total = [((PlanB − PlanA) / DaysT) × DaysR + (RemainingMonths × (PlanB − PlanA))] × 0.8.

🔽 Annual → Annual (downgrade to lower plan): Effective at renewal (within 12 months); no refunds for current period.

🔽 Annual → Monthly (downgrade frequency): Plan updates; lower monthly billing applies next cycle.

🔼 Annual → Monthly (upgrade to higher plan): Remaining annual value is converted to extra credits; the higher monthly plan fee applies immediately.

Cancellation: You may cancel anytime; access remains until the end of the paid period. No refunds.
5. Credits
The platform uses a credit system to enable certain features. All actions that consume credits are deducted from the user’s available credit balance.
Credit types: monthly credits (expiring) included in each paid plan (expire at month-end and do not roll over) and extra credits (non-expiring) purchased separately (no expiration).
Credit consumption (platform-wide): by default, monthly credits are used first; if insufficient, extra credits are used.
Rate: 1 USD = 10 credits.
Refunds: credits are non-refundable.
Credit costs

Asynchronous interviews (One-way video interview): base price of 4 credits per interview invitation sent. Additionally: video 2 credits per minute; audio 1 credit per minute; text is free. Credits are charged when the invitation is sent.

Match Score / AI compatibility: 1 credit equals 10 AI compatibility analyses (Match Score).

Additional job slots: 6 credits/day per additional slot. Each plan includes a number of job slots (Standard includes 3; Advanced includes 10). Job boost costs may vary depending on the platform.
Additional credit uses may be added over time.
6. Payments and Billing

Payments are processed via Stripe; all methods supported by Stripe are accepted.

Billing currency: USD (U.S. dollars).

Taxes are the responsibility of the purchaser.

All purchases made on the platform, including subscription payments and credit purchases, are non-refundable.
7. Intellectual Property, Data, and License
Content uploaded by users (CVs, candidate profiles, job posts, descriptions, internal notes, evaluations, and hiring process data) belongs to the party that holds the legal rights to such content.
License Granted to Tackr
The user grants TackrJobs a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to:

Process, store, and display the content

Operate and improve the platform

Develop new features

Perform analysis, metrics, and benchmarking

Train, develop, and improve artificial intelligence and machine learning systems

Maintain and improve a talent database to optimize job matching
Candidate Data Uploaded by Companies
When a company uploads CVs or creates talent profiles:

The company remains responsible for having obtained the data lawfully

The company authorizes Tackr to process the data as part of the service
-
The company agrees that Tackr may retain and process such profiles as part of its talent database, even if the company deletes its account, in accordance with the Privacy Policy and respecting candidates’ rights
Derived and Operational Data
Data generated from the use of the platform (hiring metrics, process times, interactions, feature usage, job posting structures) may be used by Tackr in aggregated, anonymized, or non-identifiable form for commercial, analytical, and product improvement purposes.
All software, trademarks, logos, and trade names ("TackrJobs", "Tackr") are the exclusive property of Tackr LLC.
8. Responsibilities and Limitations
The Services are provided “as is”.
Tackr does not guarantee:

Uninterrupted availability

Error-free operation

Success in hiring processes
Tackr is not responsible for the accuracy or truthfulness of data uploaded by third parties.
We shall not be liable for indirect or incidental damages, lost profits, data loss, or business opportunities.
Maximum liability is limited to the amount actually paid by the user in the 12 months prior to the claim.
9. Account Termination

TackrJobs may suspend or delete accounts for violations of these Terms, misuse, fraud, or inappropriate behavior.

Users may close their accounts at any time.
Termination does not automatically delete:

Anonymized data

Aggregated data

Candidate data uploaded by companies that may be retained in accordance with the Privacy Policy
10. Privacy and Cookies
Use of the platform is subject to the Privacy Policy available on our website. That policy includes the use of data for: operating the service, product improvement, development and training of AI systems, and maintaining a talent database.
Asynchronous interview videos (one-way video interviews) are stored for 90 days and then deleted, as described in the Privacy Policy.
11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States.

In case of dispute, contact contact@tackrjobs.com first for an amicable resolution.

Disputes shall preferably be resolved through binding arbitration in Delaware, with Delaware state or federal courts as a subsidiary jurisdiction.
12. Changes to the Terms

TackrJobs may modify these Terms at any time.

Minor changes will be published on the website.

Relevant changes will be notified to users via email.
13. Referral Program
TackrJobs may offer a referral program (the "Program") that allows certain users to refer new customers to the platform and receive rewards. TackrJobs may modify, suspend, or discontinue the Program at any time.
Referrer types: (i) Customer, (ii) Affiliate, and (iii) Partner. By default, users start as Customer referrers. To switch to Affiliate, you must contact us at contact@tackrjobs.com. For Partners, the applicable terms will be defined by agreement between the parties.
Referral activation (condition for rewards): a referral is considered valid and the Program is activated only when the referred user (i) has not previously had a paid plan on TackrJobs and (ii) pays for a plan (subscription). If the referred user does not pay for a plan, no rewards or commissions will be generated.
No self-referrals: you may not refer yourself (directly or indirectly), including (without limitation) by using duplicate accounts, the same individual, or the same entity to obtain rewards.
Automatic crediting: credits are automatically granted when the referral is activated. Affiliate commission is calculated automatically based on the platform’s records.
Rewards

Customer referrer: the referred user receives 300 extra credits and the referrer receives 300 extra credits.

Affiliate referrer: the referred user receives 300 extra credits and the referrer receives a commission equal to 30% of the referred user’s eligible spend on TackrJobs, capped at USD 100 per referred user. Eligible spend is based on payments actually received by TackrJobs (for example, subscriptions and credit purchases) and excludes taxes, third-party fees, and chargebacks or disputes.

Partner referrer: rewards and conditions depend on the partnership and must be discussed and agreed by the parties.
Commission payments (Affiliates and Partners): commission collection and payment method are agreed between the parties; by default, commissions will be sent via transfer to a U.S. bank account in USD, so the beneficiary must be able to receive payments through that method. TackrJobs may request additional information to verify identity, comply with legal obligations, or prevent fraud.
Right to suspend for abuse: TackrJobs reserves the right to suspend, withhold, or reverse rewards and/or commissions and disqualify referrers or referrals in case of abuse, fraud, suspicious activity, or violation of these Terms.
